Calaxo ("we," "us," or "our") provides a shift scheduling application available globally on iOS and other platforms. This Privacy Policy explains how Calaxo handles information in connection with the Service and the obligations and rights of users ("you").

By accessing or using Calaxo, you confirm that you have read, understood, and agree to this Privacy Policy. If you do not agree, you must cease use of the Service immediately.

Data We Collect

Calaxo is designed on a data-minimization principle. We do not request, require, or store personal data to operate the Service. However, the following categories of information may be processed:

We explicitly do not collect email addresses, phone numbers, full names, location data, payment information, or any special category data as defined by GDPR Art. 9. Any such data entered by users into shift fields is done entirely at their own risk and contrary to these guidelines.

Legal basis for processing (GDPR Art. 6): Processing of technical data is based on our legitimate interest in operating and improving the Service (Art. 6(1)(f)). User-entered content is processed on the basis of contract performance (Art. 6(1)(b)) — i.e., delivering the scheduling functionality.

Data Storage & Security

All shift calendar data is stored in Apple CloudKit's public database, operated by Apple Inc. under Apple's own privacy framework and data processing agreements. By using Calaxo, you acknowledge that data is subject to Apple's Privacy Policy in addition to this document.

  • Encryption at rest: AES-256 encryption via Apple's CloudKit infrastructure.
  • Encryption in transit: All communications secured via HTTPS/TLS 1.2+.
  • Access control: Calendars are protected by a unique ID and code combination. No access is possible without this combination.
  • Administrative access: Calaxo administrators may access data via the CloudKit Dashboard for monitoring, moderation, and compliance purposes.

Security notice: Calaxo cannot guarantee absolute security. No internet-based transmission is 100% secure. You share your calendar ID and code at your own risk. Loss or unauthorized disclosure of these credentials may result in unauthorized access to your calendar.

User Responsibility for Entered Data

Calaxo is a tool; the content you enter is your sole responsibility. Users must strictly comply with the following:

  • Only enter first names or initials to identify shifts — never full names, surnames, employee IDs, or other identifiers.
  • Do not enter email addresses, phone numbers, postal addresses, national ID numbers, health data, biometric data, or any sensitive personal information as defined by GDPR Art. 9.
  • Do not use Calaxo to process personal data of third parties without their explicit, informed consent and a valid legal basis.
  • If you are a business or employer using Calaxo to schedule employees, you act as an independent data controller for any personal data you choose to enter, and you bear full legal responsibility for GDPR, CCPA, PIPEDA, and any applicable local compliance.

B2B / Employer notice: If you use Calaxo to manage employee schedules, you are acting as a data controller. You are responsible for informing your employees, obtaining any necessary consent, and ensuring lawful processing under applicable employment and data protection law. Calaxo is not your data processor in the formal GDPR sense and does not sign Data Processing Agreements (DPAs). You must ensure your use of Calaxo is compliant with your obligations before using it for employee data.

Access, Deletion & Moderation

Calaxo retains the right to access, review, modify, or delete any content stored in the public CloudKit database at any time, for any of the following reasons:

  • Detection of personal data entered in violation of this policy.
  • Compliance with legal obligations or law enforcement requests.
  • Maintenance, performance optimization, or security operations.
  • At our sole discretion, including permanent discontinuation of the Service.

We may employ automated tools or manual review to detect and remediate personal data entered accidentally or in breach of these guidelines.

No liability for deletion: Calaxo may delete any calendar or data without prior notice. Users are solely responsible for maintaining external backups of their shift schedules. Calaxo accepts no liability for any loss, damages, or operational disruption resulting from data deletion.

Your Rights (GDPR / CCPA & Global)

Because Calaxo does not intentionally collect personal data, many of these rights may not be directly applicable. However, you may exercise any right by contacting us. We will respond within the timeframe required by applicable law (typically 30 days under GDPR).

You also have the right to lodge a complaint with your national data protection authority. In the EU, a list of supervisory authorities is available at edpb.europa.eu.

Calaxo does not sell personal data to any third party, as defined under the CCPA or any other applicable law.

International Data Transfers

Data stored in Apple CloudKit may be processed on Apple's servers, which are located in multiple countries globally, including the United States. Apple participates in applicable data transfer frameworks. For EEA users, Apple provides appropriate safeguards in accordance with GDPR Chapter V.

By using Calaxo from any country, you acknowledge and consent to the processing and storage of your data in international locations as described above and in Apple's Privacy Policy.

Minors

Calaxo is not directed at individuals under the age of 16 (or the applicable age of digital consent in your jurisdiction). We do not knowingly collect personal information from minors. If you believe a minor has provided personal data through the Service, please contact us immediately and we will take steps to delete such information.

Disclaimer & Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Calaxo shall not be liable for:

  • Any personal data voluntarily entered by users in violation of this policy.
  • Unauthorized access resulting from the sharing or loss of calendar ID/code credentials.
  • Any loss of data, including calendars and shift schedules, due to deletion, technical failure, or discontinuation of Service.
  • Any direct, indirect, incidental, special, consequential, or punitive damages arising from use or inability to use the Service.
  • Any regulatory fines, penalties, or legal actions against users who fail to comply with applicable data protection laws when using the Service.

Important Legal Notice

Nothing in this policy limits liability that cannot be excluded under mandatory applicable law, including consumer protection rights where applicable. This disclaimer does not affect your statutory rights as a consumer in your jurisdiction.

Changes to This Privacy Policy

We reserve the right to update this Privacy Policy at any time. Material changes will be communicated via an in-app notice or updated effective date at the top of this document. Your continued use of the Service following any update constitutes your acceptance of the revised policy.

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Calaxo ("we," "us," "our") governing your access to and use of the Calaxo application and all related services (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you unconditionally accept these Terms. If you do not agree to these Terms in their entirety, you must immediately cease all use of the Service and uninstall any application.

These Terms apply to all users worldwide, including individual consumers and businesses. Where you use the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

Description of Service

Calaxo is a shift scheduling application that enables users to create, manage, and share shift calendars using Apple's CloudKit infrastructure. The Service is provided on a best-effort basis and is intended for use as a scheduling tool only.

The Service is provided "as is" and "as available." We do not guarantee uninterrupted, error-free, or secure access to the Service at all times. We reserve the right to modify, suspend, or permanently discontinue the Service or any part thereof at any time, with or without notice.

Eligibility

You must be at least 16 years of age (or the applicable age of digital consent in your jurisdiction) to use the Service. By using Calaxo, you represent and warrant that you meet this requirement.

Use of the Service is void where prohibited by applicable law. It is your responsibility to ensure that your use of Calaxo complies with all laws, rules, and regulations in your jurisdiction.

Access Credentials

Access to calendars is controlled by a unique calendar ID and access code generated by the Service. You are solely responsible for:

  • Maintaining the confidentiality of your calendar ID and access code.
  • All activities that occur under your calendar, whether or not authorized by you.
  • Any unauthorized access resulting from the sharing, loss, or theft of your credentials.

Calaxo shall not be liable for any loss or damage arising from unauthorized use of your credentials. You agree to notify us immediately if you become aware of any unauthorized access.

Acceptable Use Policy

You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You expressly agree not to:

  • Enter, store, or transmit any personal data beyond first names or initials (including but not limited to: full names, emails, phone numbers, addresses, financial data, health data, biometric data, government IDs, or any special category data under GDPR Art. 9).
  • Use the Service to process personal data of third parties without a valid legal basis and their informed consent where required.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the Service.
  • Use the Service for any unlawful purpose or to violate any applicable local, national, or international law or regulation.
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Service's systems or networks.
  • Use the Service in any manner that could damage, overburden, or impair the Service.
  • Commercially exploit, resell, or distribute the Service without our express written consent.
  • Use automated tools, bots, or scripts to access or interact with the Service.

Violation of this Acceptable Use Policy may result in immediate termination of your access without notice and may expose you to civil or criminal liability.

Intellectual Property

All intellectual property rights in the Service, including but not limited to the application code, design, graphics, trademarks, and trade names, are owned by or licensed to Calaxo. Nothing in these Terms transfers any intellectual property rights to you.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for its intended purpose as described herein. This license does not permit any sublicensing, commercial exploitation, or use outside the scope of these Terms.

Any content you enter into the Service (shift data) remains your own. By entering content, you grant Calaxo a limited, royalty-free license to store, display, and process that content solely for the purpose of operating the Service.

Data, Backups & Service Continuity

Calaxo does not guarantee the preservation, availability, or continuity of any data entered into the Service. You acknowledge and agree that:

  • You are solely responsible for maintaining independent backups of all shift calendars and related data.
  • Calaxo may delete, modify, or make unavailable any data at any time, including upon termination of the Service.
  • Calaxo shall not be liable for any loss of data, missed shifts, operational disruptions, or any other consequences resulting from data loss or Service unavailability.

Best practice: We strongly recommend regularly exporting or screenshotting your shift calendars as an independent backup. Do not rely solely on Calaxo for operational scheduling purposes.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.

Calaxo does not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) any errors or defects will be corrected; (c) the Service is free of viruses or harmful components; or (d) results obtained from use of the Service will be accurate or reliable.

Where applicable consumer law does not permit exclusion of implied warranties, such warranties are limited to the maximum extent permitted by law.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CALAXO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
  • LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS;
  • PERSONAL INJURY OR PROPERTY DAMAGE;
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA;
  • ANY MATTER BEYOND OUR REASONABLE CONTROL.

IN ANY CASE, CALAXO'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED €100 (ONE HUNDRED EUROS) OR THE EQUIVALENT IN YOUR LOCAL CURRENCY.

Certain jurisdictions do not allow the limitation of liability for personal injury, fraud, or gross negligence, or limitations on implied consumer warranties. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable mandatory law.

Indemnification

You agree to defend, indemnify, and hold harmless Calaxo and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, fines, penalties, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service in violation of these Terms.
  • Any personal data you enter into the Service in breach of applicable data protection laws.
  • Your violation of any applicable law, regulation, or third-party rights.
  • Any regulatory action, fine, or penalty directed at Calaxo resulting from your unlawful use of the Service.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including but not limited to cases where you violate these Terms.

Upon termination, your right to use the Service ceases immediately. Any data associated with your calendar may be deleted. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 8, 9, 10, and 12.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Your Country/State], without regard to its conflict of law provisions.

Any dispute arising under or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of [Your Jurisdiction]. Notwithstanding this, Calaxo reserves the right to seek injunctive or other equitable relief in any jurisdiction.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the revised Terms with an updated effective date. For material changes, we will provide reasonable notice via in-app notification where practicable.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
